Lindsay Lohan is either going back to jail or back to rehab this AM — and TMZ is live at the Beverly Hillscourthouse to cover her case.

Lohan is set to go in front of the historically unforgiving Judge Elden Fox — who will ultimately decide if her probation-violating positive drug tests are going to land her more time behind bars.

The hearing is set to go down at 8:30 AM … so stay tuned.

Lindsay Lohan sentencing: Jail overcrowding, rehabilitation and history will play roles

Actress Linsday Lohan avoided an extended stay in county jail last month when a judge’s ruling to keep her behind bars without bail on a misdemeanor probation violation was overturned on appeal.

Lohan has been free on $300,000 bail since Sept. 24, when Superior Court Judge Patricia Schnegg agreed that the star of “Mean Girls,” “The Parent Trap” and “Freaky Friday” was entitled to post bail on a probation violation for misdemeanor drunk driving.

The decision came hours after Judge Elden Fox had revoked it and set a hearing date a month after remanding her to jail, which would have meant nearly a month in jail without being subject to early release.

Now, Fox is poised Friday to hand down a sentence in the case.

But Los Angeles County Sheriff’s Department officials said Lohan likely will spend less time in jail than the 13 days she served last summer as part of a 90-day sentence.

Jail overcrowding and a $128-million budget cut means the amount of time most women spend in county jail has been reduced from 25% of their sentence to 20% , said Sheriff’s Department spokesman Steve Whitmore.
He noted the judge has ultimate say on whether Lohan gets jail time, rehabilitation or some combination of the two.

“We have to wait and see what the judge rules, and that will determine what we do,” Whitmore said.

If Fox decides Friday that lock-up is the best place for the actress, Lohan could get at least 30 days in jail on each of the two violations of her probation on misdemeanor drunk driving. The violations are for failing court-ordered drug testing.

Although the judge could opt for a jail sentence, he could hand down a sentence that emphasizes Lohan’s continued rehabilitation.

Lohan’s attorney, Shawn Chapman Holley, is expected to argue that the actress has shown progress during her stay at the Betty Ford Center in Rancho Mirage and that she should continue her treatment.

Thus far, Lohan appears to be abiding by the conditions of her release.

But others say the decision by Holley to persuade another judge to release Lohan on $300,000 bail after Fox had already sentenced her could come back to haunt her at the sentencing hearing.

“If Judge Fox would have been satisfied with checking into rehabilitation, he would have proposed that as a disposition for admitting the probation violation,” Glen Jonas, a veteran defense attorney unconnected to the Lohan case, told The Times last month.

“Judge Fox is a fair judge, so he will consider her efforts toward rehabilitation, but there is a larger issue to deal with, and that is teaching her to respect the terms of her probation, as well as the orders of the court,” Jonas said. “I expect he will sentence her to at least 30 days jail and possibly more.”

Lindsay Lohan Gears Up For Judgement Day

Closing in on her much dreaded date before the judge, Lindsay Lohan is set to appear in court on Friday (October 22) for her probation violation hearing.

Stemming from two failed drug tests, the “Georgia Rule” actress will leave the Betty Ford Center to find out whether she’s headed back to jail or facing a continued rehab stay.

Miss Lohan has spent the past three weeks as a voluntary patient at Betty Ford as she hopes the move will help in her efforts to avoid time in the slammer – as Judge Elden Fox can give her up to a year sentence for her recent misdoings.

Of the situation, L.A. criminal defense attorney Steve Sitkoff told People magazine, “The key here is her progress in treatment. The better she’s doing in rehab, the less likely Judge Elden Fox will throw her in jail.” [Read more...]

Lindsay Lohan Could Be Sentenced Up To One Year In Jail

Judge Elden Fox could sentence LindsayLohan up to one year behind bars when she appears for her probation violation hearing on Friday, RadarOnline.com has learned exclusively .

A source close to the actress, 24, told RadarOnline.com: “Judge Fox could be inclined to sentence Lindsay on Friday up to one year in jail. The fact that he ordered Lindsay to appear, even though she is currently in rehab and not planning to fight the probation violation, has Lindsay’s legal team very, very, concerned.”

The insider continued, “Even though Judge Fox has previously said that any dirty drug test would result in an automatic 30 days behind bars, he could go above and beyond that and simply terminate her probation. If he does that, he can sentence Lindsay to up to one year in jail. She would get credit for time served from her stint at Lynwood earlier this year and would probably do four to five months in jail.”

As RadarOnline.com reported, Lindsay failed a drug test just 3 weeks after her release from UCLA Medical Center in August. She appeared in court and was immediately remanded to custody at Lynwood Correctional Facility. Her lawyer filed an appeal, however, and she was released after several hours. Lindsay then voluntarily checked into the Betty Ford Center in Rancho Mirage, Calif. where she’s been receiving treatment.

A source close to Lindsay’s camp told RadarOnline.com, “I wouldn’t be surprised if she gets a year in jail and serves six months. I think everyone close to her would like to see her go back to rehab, but there’s an overwhelming feeling that something is going to happen to Lindsay if she doesn’t go away for a long time, so they’re reconciling with the fact that she could go to jail for a while. People are scared.”

As RadarOnline.com reported exclusively on Wednesday, Judge Fox has refused to meet with Lindsay’s lawyer and the DA before Friday’s hearing.

“Judge Fox is fair, but if there is an inclination that someone has violated his orders, he doesn’t have any patience for that,” the source told RadarOnline.com.

Lindsay Lohan Told To Keep Her Mom Away From Her Career & Money

Lindsay Lohan is being advised to cut mom Dina loose from her business empire and acting career if she wants to remain sober, RadarOnline.com is exclusively reporting.

“Dina needs to no longer act as her manager, or work for her daughter in any capacity,” a source close to the Hollywood wild child told RadarOnline.com.

“Lindsay needs Dina to simply be her mother.

“Lindsay’s treatment team at Betty Ford has emphasized this to Lindsay, very, very strongly.

“Lindsay feels the financial burden of taking care of her entire family.

“It’s enormous pressure for any person in their twenties, let alone someone that is battling with addiction.”

The source added, “Lindsay and Dina don’t have a normal mother-and-daughter dynamic because of the length of time that Dina has worked for Lindsay.”

But according to the source, Lindsay, 24, has not yet accepted the advice.

“She is strong enough to tell Dina that she doesn’t want her to work for her anymore,” added the source, who has direct knowledge of the situation.

“It’s partly because it has been the norm for so long and Lindsay doesn’t know what her career would look like without her mom’s involvement.”

Lindsay’s next project is the biopic of porn star Linda Lovelace’s life, Inferno, although filming has been delayed until the starlet is released from treatment.

“Lindsay wants to get back to work, with the view, the sooner the better,” said the source.

“However, her treatment team is asking that she commit to at least another 45 days of treatment.

“Lindsay has done several 30 day rehab stints and almost every time, she has relapsed.

“We really believe that the longer she stays at Betty Ford, the better for her odds of success.”

Lindsay Lohan has been ordered to appear in court October 22 in connection with her probation violation, RadarOnline.com is reporting exclusively.

Judge Elden Fox ordered the actress to appear. She is currently at the Betty Ford Center for her addiction to cocaine. Lindsay tested positive for cocaine during one of her random drug tests that were a condition of her probation. Judge Fox previously said that any dirty drug test would result in 30 days in jail for the Mean Girls star.

Sources close to the situation tell us that Lohan won’t dispute the test results, turning the court action into a sentencing hearing instead of a more formal probation violation hearing. (Lindsay admitted that she slipped up via Twitter after initially denying it, when the first news reports of her “dirty” test appeared.)

“Lindsay will be sentenced next Friday for her probation violation,” a close source told RadarOnline.com exclusively. “Judge Fox could do several things. He could order her to jail immediately, sentence her to 30 days and suspend the sentence until she completes her stint at Betty Ford Center. Or he could come up with another scenario. “Lindsay’s fate rests with Judge Fox.”

Lindsay will be escorted from Betty Ford by at least one staff member from the facility. “Lindsay will have someone with her at all times when she leaves Betty Ford,” said a source. “They want to make sure that Lindsay is not tempted by anything.”

She’s been trying her best to look responsible by checking in to the Betty Ford Clinic, and coming up on October 22nd Lindsay Lohan will once again face the judge.

Lindsay Lohan Helping Others in Rehab

Contrary to false reports about Lindsay Lohan trying to “escape” from rehab, the truth is Gossip Cop hears she’s taking her time at the Betty Ford Center very seriously.

A source tells us she wakes up every morning at 5:30 a.m., hits the gym, and attends group and individual sessions all day, followed by AA meetings at night.

We hear she’s also been very “gracious,” signing autographs and sending birthday cards to fans.

We were also struck by the story of what Lohan did for an older woman in rehab, whose daughter couldn’t afford to visit her. We’re told Lohan bought a ticket and hotel room for the daughter, just so that she could spend time with her mom. “She paid for it all,” says our source, who adds that Lohan’s been very gracious to the other patients.

While a rep for the actress wouldn’t comment about her daily routine or Lohan’s picking up the ticket and hotel room tab for another patient’s daughter, her spokesperson did acknowledge, “She’s working very hard.”
